Warranty and Consumer Guarantee Policy

JV Auto Shop is committed to supplying automotive products that meet applicable Australian consumer guarantees. This policy explains your rights, our product-assessment process and how to request a repair, replacement, refund or other remedy when a product does not meet the requirements of the Australian Consumer Law.

Protection That Applies Automatically

Products sold to consumers in Australia come with statutory consumer guarantees. These guarantees apply independently of any additional written warranty offered by JV Auto Shop, a product manufacturer or another supplier.

Australian Consumer Law notice

Nothing in this policy excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded under the Competition and Consumer Act 2010 or any applicable State or Territory consumer legislation.

Where a product has a major failure, an eligible consumer may choose the remedy available under the Australian Consumer Law. Where a failure is minor, JV Auto Shop may first provide an appropriate repair or another remedy permitted by law.

Acceptable Quality

Products must be reasonably safe, durable, free from unacceptable defects and suitable for the purposes for which similar goods are commonly supplied, taking the product’s age, condition, price and description into account.

Match the Description

Products must correspond with the description, specifications, photographs, representations or sample used to market and sell them, subject to clearly disclosed variations.

Fit for Disclosed Purpose

Where you tell us the particular purpose for which a product is required and reasonably rely on our advice, the product must be fit for that disclosed purpose.

Express Promises

Any specific representation made by JV Auto Shop about a product’s condition, performance, characteristics or expected use must be honoured as required by law.

Major Product Failure

A failure may be major when the product is unsafe, substantially different from its description, cannot perform its normal or disclosed purpose, cannot easily be repaired within a reasonable time, or has a serious defect that would have prevented a reasonable consumer from purchasing it.

Where the Australian Consumer Law applies and a major failure is established, the consumer may be entitled to reject the product and choose between a refund or a replacement, subject to applicable law.

Minor Product Failure

A failure is generally minor when the problem can be fixed within a reasonable time and the product is not unsafe or substantially unfit for its intended purpose.

JV Auto Shop may choose to repair the product, replace the affected component or provide another remedy permitted by law. If the problem is not remedied within a reasonable time, additional consumer remedies may become available.

Product-specific and manufacturer warranties

Some products may include an additional warranty provided by JV Auto Shop, the manufacturer or another supplier. The applicable warranty period, coverage, claim requirements and exclusions will be stated on the product listing, invoice, packaging or warranty document supplied with the product.

A product-specific warranty is an additional benefit. Its expiry does not automatically end any consumer guarantee rights that may continue under the Australian Consumer Law.

Used engines and second-hand automotive parts

Used engines and second-hand automotive parts are covered by applicable consumer guarantees. However, what constitutes acceptable quality is assessed with regard to factors including the product’s age, mileage where known, price, condition, intended use and any defects disclosed before purchase.

A customer is not generally entitled to a remedy for the specific defect, wear or condition that was clearly disclosed before purchase. Consumer rights may still apply to a different undisclosed fault.

Installation, fitment and compatibility

Customers should confirm vehicle compatibility, dimensions, part numbers, engine codes, mounting points, electrical connections and other relevant specifications before installation.

Engines, wheels, seats and safety-related components should be installed by a suitably qualified and experienced automotive professional where appropriate.

A voluntary product warranty may not cover damage caused solely by incorrect installation, unsuitable fitment, unauthorised modification, misuse, contamination, overheating, accident or failure to follow installation instructions. These exclusions do not remove any statutory rights where the product itself failed to comply with a consumer guarantee.

Matters that may not establish a warranty claim
  • Normal wear and deterioration reasonably expected from the product’s age, condition, mileage or use.
  • A fault or condition clearly disclosed before the customer agreed to purchase the product.
  • Damage caused after delivery by accident, neglect, improper storage, misuse or abnormal use.
  • A change of mind where the product is not faulty and otherwise complies with the consumer guarantees.
  • Incompatibility caused by incorrect vehicle information supplied by the customer, unless JV Auto Shop independently recommended the product for that vehicle.

These circumstances are assessed individually and do not exclude a remedy where one is required under applicable law.

Inspection, return freight and collection

JV Auto Shop may reasonably inspect or arrange an assessment of a product before confirming the appropriate remedy. Customers should not return a large automotive component without first receiving return instructions.

Products that can be posted or returned without significant difficulty may need to be sent back for assessment. Where required by the Australian Consumer Law, reasonable return costs will be reimbursed after the fault is confirmed.

Where a faulty product is large, heavy, installed or difficult to transport, JV Auto Shop will make appropriate collection or freight arrangements where legally required.

Proof of purchase and supporting information

Please provide reasonable proof that the product was purchased from JV Auto Shop. This may include an order confirmation, invoice, receipt, payment record or other reasonable evidence of the transaction.

Depending on the product and reported problem, we may request photographs, video, fault codes, a mechanic’s report, installation records or other information reasonably required to assess the claim. Any request will be proportionate to the nature and value of the product.

Compensation and reasonably foreseeable loss

Where a product’s failure causes additional loss or damage, a consumer may have a right to compensation for loss that was reasonably foreseeable and directly connected with the failure.

Claims for additional loss will be assessed in accordance with the Australian Consumer Law and should be supported by relevant records, invoices or other reasonable evidence.

How to Make a Warranty or Consumer Guarantee Claim

Contact JV Auto Shop as soon as reasonably possible after discovering the problem. We will review the information, provide return or inspection instructions and explain the next steps.

Stop Using an Unsafe Product

Discontinue use immediately where continued operation may cause injury, vehicle damage or further product damage.

Contact JV Auto Shop

Provide your name, order number, product details, vehicle information and a clear description of the problem.

Supply Supporting Evidence

Include photographs, video, diagnostic information or installation records where reasonably relevant to the reported fault.

Assessment and Remedy

We will assess the claim within a reasonable time and provide the remedy required by applicable law.

Important safety instruction

Do not continue operating a vehicle where an engine, wheel, seat, restraint component or other automotive part may be unsafe. Stop use, secure the vehicle and obtain qualified mechanical advice. Contact JV Auto Shop before dismantling, modifying or returning the affected product, except where immediate action is reasonably necessary to prevent injury or further damage.

Submit your claim directly to JV Auto Shop. We will not require an eligible consumer to deal only with the manufacturer where JV Auto Shop has a legal obligation to provide a remedy as the supplier.
